New York Attorney General Letitia James announced a permanent ban on former Celsius CEO Alex Mashinsky for his involvement in cryptocurrencies, securities and commodities.

Mashinsky Faces Up to $35M Under New York Settlement

There are two significant financial conditions to consider about the settlement. If Mashinsky fails to turn over an additional $10 million of alleged ill-gotten gains to the federal government, then he will have to cover the $25 million fine he faces in New York.

He might also be on the hook for an additional $10 million if he doesn’t finish his prison term. The federal case, which is separate, is on hold after Mashinsky was ordered into a 12-year prison sentence. He also had to pay over $48M to the Fed forfeiture.

Lifetime Ban Extends Across Crypto and Financial Markets

The New York treaty forever barred Mashinsky from any involvement in cryptocurrency, securities and commodities business. One of crypto’s largest lending platforms Celsius is invited to a whole new level of consequences under the restriction.

New York officials charged Mashinsky with improper registration, and misleading investors regarding the state of the company and how it treats its investments.

Celsius Investors Were Told the Platform Was Safer Than Banks

Celsius lured users to its platform with offers of interest on your cryptocurrencies. Mashinsky was placed in the spotlight, and he regularly appeared on TV and social media to advertise Celsius.

He repeatedly told New York investigators Celsius was a safer way to invest than traditional banks and touted its investment approach as low-risk, he said.

In subsequent allegations authorities claimed customer funds were used in risky endeavors that resulted in a loss of hundreds of millions of dollars that had been hidden from investors.

The lawsuit included hundreds of thousands of Celsius users, such as over 26,000 investors in New York.

Celsius Creditors Have Received More Than $3.4B

Following its 2022 withdrawal freeze while going into bankruptcy, Celsius customers cannot withdraw from the platform.

As of August 2026, bankruptcy has made distributions totaling over $3.4 billion to creditors. Individually, Celsius executives and founders had to pay the FTC $16.5 million.

Now the New York settlement wraps up a big crackdown on the lender’s demise, while simultaneously preventing Mashinsky from being available for regulated crypto or mainstream financial markets.
